Article 1 Subject of License

1. This Agreement sets forth the terms and conditions of use applicable to "adaptation patch of T-Engine Appliance/SH7619, " the patch for modification of T-Kernel Version 1.02.02 (hereinafter called the "Patch").

Article 2 Terms and Conditions for License

1. The terms and conditions for a license of the Patch shall be subject to the "T-License Add1" separately established by T-Engine Forum.

Article 1. Scope of Memorandum

1. This Agreement sets forth, in connection with the T-License, copyrights and the terms and conditions of use applicable to the patch of the source code of T-Kernel distributed by T-Engine Forum and any derivative work created therefrom.

Article 2. Definition

1. Except for the following terms, the terms used herein shall have the same meaning as defined in the T-License.
   1. "Patch" means the "Patch for Modification" which is to be the subject of this Agreement.

Article 3. Copyrights and License for Distribution of Patch

1. The copyrights of the Patch shall be owned by the copyright holder described on the Patch.
2. The copyright holder grants to T-Engine Forum a license to distribute the Patch under this Agreement.

Article 4. License to use the Patch

1. T-Engine Forum shall, free of charge, grant a license to use the Patch and provide the Patch to any person who has taken the necessary procedure for registration as prescribed by T-Engine Forum and agreed to this Agreement (such a person is hereinafter called the "Patch User").
2. The Patch shall be distributed exclusively by T-Engine Forum. No person who obtains the Patch may make any re-distribution of the Patch.
3. The Patch User may perform the following acts:
   1. to apply the Patch obtained under Article 4.1 above to the source code of T-Kernel (the "Source Code") and create the Modified Source Code;
   2. to copy and/or modify the Modified Source Code created in accordance with the provision of (1) above for its own research, development and the like;
   3. to run the Modified Source Code created in accordance with the provision of (1) above for its own research, development and the like; and
   4. to run the Source Code modified from the Modified Source Code in accordance with the provision of (2) above for its own research, development and the like.
4. The System Developer may perform the following acts:
   1. to perform any and all acts set forth in the preceding paragraph; and
   2. to develop and manufacture the Embedded Product containing the Binary Code, and, whether with or without payment, provide the End User with the same and make the Binary Code available to the End User on the Embedded Product.
5. The Patch User and the System Developer shall be obligated to give a notice that the Patch is used, in such a way as separately established by T-Engine Forum, when they use the Modified Source Code created by applying the Patch to the Source Code or the Binary Code, or make the Binary Code available for the End User on the Embedded Product.

Article 5. Warranty

1. T-Engine Forum and the copyright holder of the Patch warrant that the Patch does not infringe upon third party's copyrights.
2. Neither T-Engine Forum nor the copyright holder of the Patch warrants that the Patch will fit for any particular purpose of the Source Code User.
3. Neither T-Engine Forum nor the copyright holder of the Patch warrants that the Patch does not infringe upon any third party's industrial property rights. In no event shall T-Engine Forum and the copyright holder of the Patch be liable for any dispute which may arise between the Source Code User and a third party in connection with the third party's industrial property rights.

Article 6 Indemnity

1. Neither T-Engine Forum nor the copyright holder of the Source Code shall be liable for any damages (including, but not limited to, damages resulting from loss of profit, business interruption, loss of business information or any other pecuniary damage) arising out of use or imposibility of use of the Source Code, even if T-Engine Forum and the copyright holder have been informed of the possibility of such damages.

Article 7 Other provisions

1. Any matters not provided for in this Agreement shall be subject to the provisions of the T-License.
